Overview
- Full name
- Regulation (EU) 2023/1542 concerning batteries and waste batteries
- Authority
- European Commission + member-state market surveillance
- Effective
- Partly in force 2024.02.18 · DPP mandatory 2027.02.18
- Scope
- Five categories: portable / industrial / EV / light means of transport (LMT) / SLI
- Mechanism
- PCF declaration + materials due diligence + Digital Battery Passport + recycled-content shares + collection / recycling rates
The EU Battery Regulation sets systematic requirements for lifecycle carbon footprint, raw-material due diligence, recycled content and digital passports. Duties phase in by battery category and supporting acts: DPP applies from 18 Feb 2027 to LMT, EV and industrial batteries above 2 kWh; raw-material due diligence was postponed by Regulation 2025/1561 to 18 Aug 2027; minimum recycled-content shares apply from 18 Aug 2031. Operators placing batteries on the EU market, including batteries embedded in vehicles and electronics, must confirm duties by role and battery category.

Key requirements
Meet these core requirements to comply and access the market.
PCF declaration: report battery carbon footprint per ISO 14067 / GHG Protocol Product.
Material due diligence: full-chain due diligence on cobalt / lithium / nickel / graphite, with a published policy.
DPP (mandatory 2027.02.18): carrying PCF / material composition / origin / dismantling & recycling information.
Recycled content: minimum recycled shares for cobalt / nickel / lithium / lead apply from 18 Aug 2031.
Removability / replaceability: portable batteries must be readily removable and replaceable by end users.
Collection & recycling: extended producer responsibility for collection and material-recovery rate targets.
Labelling: CE / capacity / chemistry / rechargeable marking and a QR code, among others.
Penalties: non-compliant batteries can be barred from the market and fined.

FAQ
When exactly does the Digital Battery Passport become mandatory?
From 18 Feb 2027, industrial (> 2 kWh), EV and LMT batteries must carry a DPP containing PCF, material composition, origin and dismantling / recycling information.
We only assemble packs and buy cells — do we still need due diligence?
Yes. Due diligence covers the full chain for cobalt / lithium / nickel / graphite; whether self-produced or purchased, you must trace upstream and retain evidence.
How is recycled content proven?
Evidence follows the regulatory methodology, technical documentation and supply-chain data. Minimum shares apply from 18 Aug 2031 under the accounting and verification rules then in force.
